A charter school story

I want to apologize to Schools Matter readers for my infrequent contributions. I thought once I graduated from law school and passed the most difficult bar examination in the country on my first attempt, that I'd have more time to write. Instead, in addition to my long-time day job, I now have an internship once a week at an education law firm, and I am teaching on Thursday nights at my law school. In a word — I'm swamped. However, I managed to piece together this twitter thread on Monday, that I thought was worth reposting here.


Researching for a case and came across a personal injury settlement between a charter school corporation in the Central Valley and multiple student plaintiffs for some $6-million+. The amount is on the low side considering the horrific injuries some of the students suffered.

It was the typical charter school money-making scam. They had a former employee form an unregistered and uninsured transportation company. The charter's Vice Principle provided one of their family's vehicles to that company. They paid themselves $6K a month from public money to operate a vehicle that had several defective seatbelts. Moreover, they consistently exceeded the vehicle's passenger capacity. Students had to share seats and some had to ride on the floor.

Struck by another vehicle traveling at high speed, the charter corporation's vehicle rolled multiple times and ejected several of the unrestrained students. The injuries were as bad as you could imagine them to be.

This was the inevitable result of putting public money into private hands. Because charter school corporations are privately managed with de minimis oversight, transparency, and accountability, they find ways to channel public revenue streams into their pockets, all the while cutting corners on students. Here, that cost cutting had drastic consequences that altered the lives of several students whose injuries were severe.

In this case it was a transportation company that the charter corporation created, but we've seen the same thing with Charter Management Organization real estate holding firms, and charter school side-companies like convicted felon and charter school mogul Refugio 'Ref' Rodriguez's Better 4 You Foods and Better 4 You Fundraising.

The diversion of public funds to private pockets doesn't stop at individual charter school corporations, as evidenced by their trade association—the California Charter Schools Association (CCSA). CCSA sells its member charter schools products and services, paid for out of the public purse. One of them, which would later become known as CharterSafe, generated profits so lucrative, that large firms like Travelers and Gallagher & Co. partnered with them. Here's a quote from a CCSA executive:

"…generated 30% profit margins in subsequent years–with 20-30% lead generation and 20-50% close ratios."


Postscript:

The examples of charter corporation greed and self-dealing keep increasing. It's the inevitable result of putting public money into private hands.

Corporate charter school mogul Refugio “Ref” Rodriguez has been in the news lately. First, for his being elected President of the Los Angeles Unified School District (LAUSD) Board of Education. Second, he is facing criminal charges of three felony counts, including conspiracy and perjury, and 25 misdemeanor counts of assumed name contribution.

Who is this rising star of the California Charter Schools Association? How did he end up on LAUSD’s board despite having never attended, nor worked at a public school? Why are these charges no surprise to Los Angeles public education activists? All of the questions and more answered in a talk by Robert D. Open letter to Dan Woods regarding the Gülen Network's Magnolia Charter Schools

Mr. Woods:

Just read your heavy-handed letter [1] to Arthur M. Pakowitz, Esq.

As a courtesy I wanted to address some of your concerns, which are clearly based in your ignorance regarding both privately managed charter schools, and the shadowy Gülen cult that your client is associated with.

Regarding your insistence that the Magnolia corporate charter school chain's financial information is transparent. This simply isn't the case, and it wasn't until the public school district called for an audit that one was conducted. Said audits revealed millions of "missing, misused funds" [2]. These were public dollars, squandered under the private management of your client.

You then make the absurd assertion that "Magnolia's eleven charter schools are public schools…" In case you actually believe that misrepresentation, let me disabuse you.

Generally charter schools are not public schools. Both existing case law and public policy have long established this. The Washington State Supreme Court (2015) held that charter schools are not "common schools" because they're governed by appointed rather than elected boards. The 9th Circuit US Court of Appeals (2010) ruled that charter schools are not "public actors." The California Court of Appeals (2007) ruled that charter schools are not "public agents." The National Labor Relations Board (NLRB) joined many other government agencies in unequivocally determining that charters are, in NLRB's words, "private entities."

By definition if a charter school is run by a for-profit company, or a (501c3) non-profit corporation (e.g. Magnolia Educational and Research Foundation), then it is not a public school. The United States Census Bureau frames this issue best: "A few "public charter schools" are run by public universities and municipalities. However, most charter schools are run by private nonprofit organizations and are therefore classified as private." [3]

Because these lucrative charter schools are not public, and are not subject to even a modicum of public oversight, they are able to get away with violating the constitutional rights of their students. The decision in Scott B. v. Board of Trustees of Orange County High School of the Arts saw Rosa K. Hirji, Esq. write: "The structures that allow charter schools to exist are marked by the absence of protections that are traditionally guaranteed by public education, protections that only become apparent and necessary when families and students begin to face a denial of what they were initially promised to be their right." [4]

Lastly, there is ample documentation tying the Magnolia corporate charter school chain to the Gülenist Movement, namely through their intertwinement with the Los Angeles based Pacifica Institute—a Gülen organization which denies the 1915-1918 Armenian genocide. [5] Moreover, Fethullah Gülen's ties to the Magnolia charter schools was reported to Turkish readers as early as 2010. [6]

Far be it for me to do your research for you, but as a courtesy I offer the following footnote [7] as starting point for your own additional discovery.

I understand that the model rules of professional conduct call upon you to vigorously represent your client's interests, but one would expect an attorney of your standing to at least base your arguments in a modicum of reality. I suppose in a way I owe you and your firm a debt of gratitude inasmuch as you provide examples of the type of attorney I don't want to be—seemingly ones that hold billable hours more important than the public interest.

2015 Week 28 Education Odds and Ends

Deasy not given his due

An EdSource piece by the respected Carl Cohn makes the tired old case for "breaking up" Los Angeles Unified School District. Cohn lists multiple recent missteps in his case — MiSiS cRiSiS and Pearson/iPad scandal among them — but never once mentions the common denominator of all the missteps, perhaps because of EdSource's sources of funding. I addressed Cohn's lack of attribution thusly:

Mr. Cohn, how coy of you not to provide full credit to John Deasy for nearly all of the woes you enumerate above? The Broad Superintendents Academy "graduate" oversaw (read masterminded) MiSiS, iPads, and many more projects that left the district in disarray, nearly bankrupt, with little more than the ability to manage damage control rather than implement any of the forward looking projects you allude to. While some say that Deasy, and all of the Nonprofit Industrial Complex (NPIC) organizations that supported his abject tenure, were following the Andy Smarick roadmap for scuttling school districts (outlined in his "Wave of the Future" essay in the fringe-right EdNext journal), I would posit it sounds more like Broad's meddling.

Duncan given his due, for the most part

Arguably the doltish Arne Duncan is either the worst Secretary of Education in all of U.S. History, or the best corporate bagman to ever occupy the post. Honestly, he's both. The distinguished Professor Diane Ravitch excoriates the inept education chief in her response to Lyndsey Layton's ham-handed paean to Duncan.

Eric Lerum showing off his neckbeard I was on Twitter the other day and noticed someone mansplainin' a teacher acquaintance of mine. The offender was none other than former Michelle Rhee minion Eric Lerum. When the teacher made the correct assertion that privately managed charter schools engage in selective enrollment, Lerum made the following bizarre statement:

Incredulous at the neoliberal corporate reformer's statement I provided hard evidence from the Office of Independent Monitor (OIM):

Lerum did not respond to that tweet, presumably because his entire argument rests on ignoring facts. Neither he, nor any other corporate reformer, are able to address the issue. Instead, he kept berating my teacher friend by citing policy papers (as opposed to legitimate research) by the Center on Reinventing Public Education (CRPE), a fringe-right think-tank funded by reactionary ideologues including: The Bill & Melinda Gates Foundation, Carnegie Corporation of New York, Fund for Educational Excellence, The Joyce Foundation, Laura and John Arnold Foundation, Michael and Susan Dell Foundation, National Alliance for Public [sic] Charter Schools, Walton Family Foundation, and The Broad Foundation.

At one point Lerum stated in regards to the significant under enrollment of Students with Disabilities (SWD), particularly low incident ones, "not enough to look at #s - must also examine cause of #s." Lerum holds a Juris Doctor, and I'm working on mine, so let me make this as simple as possible for him to understand in legal terms. The ostensible reasons why the lucrative charter school industry refuses to educate SWD are not important as this is a strict liability offense. Lack of specific intent, mistake of fact, or mistake of law are no defense here. Charters do not educate every child, and as such, must be held strictly liable for their crimes. Sorry to threaten the charter sector's profits, but that's the reality, and no amount of un-juried policy papers masquerading as "research" will change that.

The teacher then cited the illustrious Professor Antonia Darder's Racism and the Charter School Movement: Unveiling the Myths.

Lerum's maladroit response speaks volumes to his limited understanding of education, and research in general. It is no exaggeration to say that Darder is an intellectual giant in the field of education. Years ago I remember one of my mentors, Dr. John Fernandez, saying "sure you've read McClaren, Macedo, and Giroux, but you need to read Darder, she's the closest thing to Freire." Professor Darder can write a piece like she did in Truthout precisely because she's written dozens of books, and peer reviewed articles. What does Lerum have to his credit? A few poorly composed and fact-free Huffington Post pieces? Yet leave it to the corporately sponsored Lerum to question the veracity of one of the preeminent scholars of our age.

It shouldn't surprise me that a neoliberal corporate education reformer like Lerum doesn't know the difference between peer reviewed works and policy papers. Nor should I be surprised that he didn't have the good sense to avoid insulting a luminary in the field of critical pedagogy. Moreover, while he had tons of mansplainin' on hand for my female teacher friend, as soon as I confronted him with the OIM report, he went silent. His only response to me was to assert that my questioning of CRPE's funders wasn't "substantive". I would posit that his staunch defense of his corporate funders and allies speaks for itself.

Keeping up with all of Rodriguez's financial scandals and possible felonies is difficult, but the following articles and resources should help:

The NPIC further undermining LAUSD

The usual Nonprofit Industrial Complex (NPIC) suspects are hard at work in their never ending quest to bankrupt public education in Los Angeles. News that they were dissatisfied with the district's implementation of Local Control Funding Formula/Local Control Accountability Plan (LCFF) would be surprising given how they drove the entire process, except when viewed from the perspective that they never intended for LCFF to do anything but break the district. I had the following to say:

This is somewhat surprising given that UWGLA and their anti-public education CLASS "coalition" (read Eli Broad proxy groups) held so much sway over the entire LCFF process in LAUSD. For a while it looked like all the decisions for LCFF were being coined by John Deasy under the direct supervision of Elise Buik and Maria Brenes.

With more current news that a leading Broad Foundation funded group is suing the district, there's a need to create a community based opposition to the NPIC driving the entire process. Fortunately the folks at Schools Los Angeles Students Deserve are doing just that with their Instituto de Padres / Parent Institute next weekend.

Roosevelt High School and the Boyle Heights community have a long and proud history of fighting for social justice, from the election of Ed Roybal to the Los Angeles City Council in 1949, to the fight against Prop.187, and to the current struggle against the scheduled layoffs of 23 RHS teachers and the struggle to dump PLAS. This video was taken when the Great Recession began and when PLAS came in. In June of 2008, when this video was produced, there were about 240 RHS teachers, now there are only 110 and dozens of classes have been cut. Karen Wolfe on LAUSD election fallout

Public school parent and member of the Venice Neighborhood Council Education Committee Karen Wolfe wrote an excellent piece looking at the May 19, 2015 Los Angeles Unified School District (LAUSD) Board elections entitled LA Election Lessons: Anatomy of a Shakeup … in the LAUSD Board Races. I made the following comments:

Scott M. Folsom on student mental healthcare

Suing a school district for failing to provide mental healthcare may seem, at first blush, to be a stretch. What part of the 3Rs is mental healthcare? But this is a stretch that is needed – like those stretches people who exercise do before they exercise.

Education is about stretching our little grey cells. It’s about being safe and well and healthy. Maslows’s Hierarchy of Needs: Food, Comfort, Safety.

  • You can’t learn if you are hungry.
  • You don’t learn if you don’t have a place to live.
  • You won’t learn if you don’t feel safe.

Then and only then can we get down to the Rs.

In Compton and in most of the brink o’ th’ apocalypse they inhabit the school nurse is most students’ primary-and maybe-only healthcare professional and medical provider. The school nurses’ office has become the Health Office has become the School Wellness Center – even as the School Nurse has become a vanishing species, repurposed to paperwork shuffling and IEP Compliance Officer – often traveling from school-to-school on a one-day-a-week rotation.

This has all worked out because school health crises: The flu outbreak, the second grader who falls out of a tree, the incident of diabetic or anaphylactic shock – these only occur on the days the nurse is at the school and is otherwise available. I have spent some of the last month reading essays by middle-schoolers about the impact of violence and trauma on their lives. Most need additional instruction on narrative storytelling  (and grammar+punctuation) …but the far more pressing need is for mental health professionals to begin to have the conversation with them about their lives.

LAUSD in planning to eliminate some psychiatric social workers in next year’s budget. The bad-news masquerading otherwise is that the District is not going to eliminate as many as first proposed. Nobody in their right mind is proposing to rehire mental health workers previously laid off.  But I am.

Post Traumatic Shock Disorder is not just for returning warriors anymore. This is not John Boy’s America. This is not the Bobsey Twins’ America. Rebecca of Sunnybrook Farm graduated decades ago and doesn’t come back for the alumni meetings ‘cause she’s scared of the neighborhood. Today’s narrative was written back in 1969: “Oh, a storm is threat'ning / My very life today / If I don't get some shelter / Oh yeah, I'm gonna fade away.”

By ‘75 Bob was feeling better about it than Mick+Keith in ‘69:

“Come in,” she said, “I’ll give you shelter from the storm”

It’s an apt metaphor to duck in under.

Alliance Charter's Judy Burton still union busting

Right-wing extremists Antony Ressler, Richard "Dick" Riordan, and Judy Ivie Burton are still turning children into profit centers, and union busting at the Alliance Corporate Charter Chain. The ongoing struggle for their beleaguered educators to organize themselves continues. Community activists are taking the struggle to the streets, and posted this and other photos on facebook with the following caption:

"Jack," a frequent commenter on Professor Diane Ravitch's site, sent me the following critique of Joshua Emerson Smith fluff-job of charter school profiteer Refugio "Ref" Rodriguez. The fact-free ham-fisted Smith piece appeared in that trashy porn and masseuse ad pennysaver known as the LA Weekly (aka Weakly)—a bastion of Jill Stewart's brand of Ayn Rand Libertarianism.

To Joshua Emerson Smith, (the author of the above L.A. WEEKLY article):
 
As with someone else who just posted, I'm also utterly shocked that you didn't mention the troubling and shocking revelations about Ref Rodriguez that emerged from a recent state audit---the same audit that Ref's ally Monica Garcia pulled out all the stops to keep sealed, but ultimately failed to do so.  (See the video of Monica and Ref standing side-by-side at last year's California Charter School Association shindig---this video is posted elsewhere in the COMMENTS section.)
 
Seriously, dude, writing an article about the Kayser / Rodriguez 2015 election, and not mentioning "Food-gate" even once is akin to... oh, I dunno... 
 
... writing about the 2004 Presidential election and not mentioning Bush's ill-advised invasion of Iraq, and most importantly, the fact that no WMD's were found... therefore the entire justification for taking us into that war was all a  manufactured hoax...

... writing about the 2010 Brown / Whitman gubernatorial election, and not mentioning "Maid-gate"...

What's up with that?  

To get you (and others) up to speed, here's a recap:

In a May 2nd Los Angeles Times' article, reporters Zahira Torres and Howard Blume detailed the troubling corruption and outrageous malfeasance that a state audit uncovered operating within Ref Rodriguez' charter school organization, "Partnership to Uplift Communities"(PUC).  Mr. Rodriguez founded this charter chain, and currently serves as its PUC's CEO and Treasurer.

Employing a wealth of documentation, the state auditors cite systemic wrongdoing and illegal misuse of taxpayer funds on the part of PUC’s Director of Business and Development, Ms. Jacqueline Duvivier Castillo, and by extension, on the part of Founder / CEO, Mr. Rodriguez, and Jacqueline Elliot, PUC's other Chief Executive.  

After all, Ms. Castillo---it should be noted---was hired by Mr. Rodriguez and Ms. Elliott, and works under their direction.  As such, Mr. Rodriguez and Ms. Elliot bear ultimate responsibility, and gave ultimate approval to the problematic purchases and decisions that that both the state audit condemned, and that the May 2 Times' article exposed to the public.
 
And exactly what did Ref & Co. at PUC perpetrate? 

Ms. Castillo willfully chose to misuse her position to award PUC's multi-year, multi-million-dollar food contract to "Better 4 You Meals", a company that, to quote the audit, is "one hundred percent owned" by Ms. Castillo (!!!).  In the process, she enriched both herself and her husband Fernando---a top executive in that company, "Better 4 You Meals."  

While the charter school laws technically require Ref to run PUC as a "non-profit", so as to prevent such profiteering by charter officials, Ms. Castillo (and perhaps Ref?) evaded this by contracting out their food service to a for-profit company that she and her husband own.   (This is a common shabby practice within the charter industry... by the time such shenanigans are uncovered, that taxpayer money that these crooks pocket is gone, baby, gone... never to be recovered... as is the case with Ref's / PUC's "Foodgate" imbroglio.)

Again, this is all detailed to the state audit report, quoted and reported on by the reporters in the Times' article.

The Times' article further states:

" --- Duvivier Castillo failed to properly report her financial interests in the company

" --- The company was ineligible for the food contracts because it lacked a health permit and relied on a subcontractor to prepare meals.

" --- PUC Schools did not select the lowest-priced bidder as required."

So, in addition to the gross impropriety of the process itself, and to the heinous misuse of the taxpayer money that funds charter schools like the PUC chain, Ms. Castillo's company, "Better 4 You Meals", operates in a substandard fashion, and thus delivered a demonstrably substandard product, as the food preparation, delivery, storage, etc. "lacked the required health permit."

Since Mr. Rodriguez hired Ms. Castillo to work at PUC, he almost certainly knew of her business holdings and interests---i.e. her and her husband's ownership of "Better 4 You Meals." 
 
Might Mr. Rodriguez have profited from any secret kickback from Ms. Castillo in exchange for approving the "Better 4 You Meals" contract?  Perhaps.  We do not know.  If the answer is "No" and he knew that Ms. Castillo owned "Better 4 You Meals", then why did he approve a multi-year, multi-million dollar contract for this same company ?  To quote "THE SOPRANOS", do you really think that Ref (or Ms. Elliot) didn't "get a taste" of this?  If not, what was in it for him to do so?

Furthermore, even if you assume that Mr. Rodriguez is criminally "innocent", and really did NOT know of Ms. Castillo's conflict of interest, then, at the very least, Mr. Rodriguez most certainly SHOULD have.   That's a key part of his freakin' job, for God's sake!!!  His failure to know this, and his failure to do the due diligence necessary to discover it, and to remain aware of this when making relevant decisions reflects poorly on his abilities as an administrator.  He also should have asked and required that Ms. Castillo produced the required health permit.  At the very least, Ref is most certainly "guilty" of gross administrative incompetence and negligence.   All of this renders Ref unfit to manage LAUSD's $7-billion-dollar budget. 

To date, Mr. Rodriguez himself has refused to comment on this scandal---hoping to just lay low until the election is over, as he squeaks through to an ill-gotten victory.  Such silence on his part speaks volumes.

To paraphrase Harry Truman, "the buck should stop" with Mr. Rodriguez, as he is PUC's Founder, CEO, and Treasurer.  
 
Bennett Kayser's constituents (like me) can tell you that "the buck" most certainly DOES stop with Bennett, as evidenced by his diligent responsiveness to their concerns (i.e. his opposition to the I-pad purchase and resulting debacle.)  
 
The students, parents, and citizens of LAUSD District 5 can ill afford to have someone like Mr. Rodriguez to be one of only seven individuals (the seven Board Members) in charge of LAUSD finances, a solemn responsibility that Board Member Kayser---a 30-year teacher and school administrator, by the way---has approached with the utmost care and seriousness.  

In the last four years---and in contrast to Ref's record---neither Kayser nor anyone on his staff, nor anyone connected to him in any way has benefited financially from any action that Board Member Kayser has taken.  Nor has anyone been involved in any corruption of any kind while he has been fulfilling the oath that he took in July 2011.  Profiting or enriching himself is most certainly NOT why Bennett is serving on the board.  Just as in his teaching and school administrator career, it's not about him;  it's about the well-being of 670,000 students, their parents and the community as a whole for which he is responsible.  
 
Unlike Rodriguez and others, it's not a fear of being caught that drives Board Member Kayser to avoid financial impropriety, eschew personal enrichment, and remain on the "straight and narrow";  it's Bennett's own conscience and moral code.  I can vouch for this, as I've known him personally for years.  That's all part of the solemn vow that an LAUSD Board Member takes when he is sworn into office.  If re-elected, Bennett's track record on this score, of course, will continue for the next four years, and for as long as Bennett serves as a public servant. 
 
Mr. Rodriguez' actions, as detailed in the May 2 Los Angeles Times' article, call into serious question his own ability to do likewise.

Indeed, a key part of Bennett's job as the incumbent District 5 Board Member these last four years on LAUSD's board has been to manage LAUSD's budget, and know in as great detail as possible where every penny of that $7 billion goes.  This truly is a task on a par with memorizing the phonebook, but it is a job that a School Board member must be willing and able to take on. Bennett has overseen and balanced three consecutive budgets of $7 billion each, and one that services 670,000 students and the adult staff that serve them!!! Top that, will you?
 
How does Ref's track record compare to this?
 
Well, according to writer and activist Robert Skeels, "Ref Rodriguez couldn’t keep one school, with only 100 students, balanced for nine years (9) straight! This 'insolvent' bad apple is Lakeview Charter, part of the Rodriguez/PUC charter chain. Ham-handed attempts by Rodriguez’s supporter to hide the Office of the Inspector General’s (OIG) audit of the Rodriguez-run PUC Lakeview Charter School, and affiliated enterprises, have been exposed."

Again, the state audit's report clearly calls into question Mr. Rodriguez' capabilities in this area.  

Once the audit hit the news, Ms. Castillo quickly left PUC, with PUC executive Ms. Elliot making the only public comment on the matter... stating that they didn't know about the conflict of interest, and that there was no wrongdoing on anyone's part.

What about Ref's response? So far, incredibly, there's been RADIO SILENCE FROM REF RODRIGUEZ HIMSELF.  I am sorry, but the Mr. Rodriguez and the folks at PUC cannot have it both ways.  They cannot, on the one hand, fire Ms. Duvivier Castillo (or pressure her to resign), and then, on the other hand, claim---as Ms. Elliot has---that there was no wrong-doing on her or anyone else's part.  
 
If Ms. Castillo--and by extension, Ref and Ms. Elliot--- truly did nothing wrong, as PUC officials claim, there is no reason for Ms. Castillo to leave PUC, and no reason for Ref to clam up about the whole sordid affair.
 
Innocent people do not run away (like Ms. Castillo has);  guilty people do.
 
Innocent people don't clam up (like Ref has); they speak out and clear their name.

If you've got nothing to hide, you hide nothing.

In the LA Progressive piece What the PUC Is Going on Here? Hans Johnson and Hector Huezo of the East Area Progressive Democrats take a look at Refugio "Ref" Rodriguez's myriad financial "mishaps." These include: the fishy max campaign contributions from employees paid minimum wage; the eye-opening audit of PUC's Lakeview finances; and passing mention of the FoodGate money laundering scheme that saw PUC employees self-dealing. The latter issue has become such a scandal that now has both the The L.A. County District Attorney and the L.A. Unified Inspector General are investigating PUC corporate officers including Jacqueline Elliot and Ref Rodriguez. What are Ref Rodriguez's ties to the Gülen cult, and why is the Armenian community supporting Bennett Kayser?

Who has ties to the cultish Gülenist Movement? Fethullah Gülen, Ref Rodriguez, Caprice Young, Monica Garcia, Richard Vladovic, Reed Hastings, Yvonne Chan, and Carrie Walton Penner

Refugio "Ref" Rodriguez is arguably as secretive as the Gülen religious cult. Secrecy isn't the only thing the two charter giants have in common. While there's no direct evidence of collaboration, there is plenty of circumstantial evidence connecting these charter conspirators.

Rodriguez's charter empire and Gülenist movement are both funded by Walmart fortune heirs. The LA School Report blog's Vanessa Romo wrote about Rodriguez's corporate charter network on January 20, 2015:

"All got their seed money from the biggest players in education reform — either the Walton Family Foundation or the Bill and Melinda Gates Foundation. He [Ref Rodriguez] says all but a handful of PUC schools out-perform the surrounding public schools." [emphasis mine]

The same Walton Family Foundation funds the largest chain of privately managed charter schools in the United States, namely the Gülenist Movement:

"The Walton family, founder of Wal-mart, the worldwide retail giant, has donated millions of dollars to schools considered to be associated with the Gülen community." [emphasis mine]

The common thread is Walmart fortune heiress, Carrie Walton Penner. She is currently the California Charter Schools Association's (CCSA) Board Vice-Chair (term ending 6/30/2017). Her close friend Rodriguez was a CCSA Board member from 2005 to 2009. Her mutual funding of both Rodriguez's lucrative PUC corporate charter network, and the Gülen charter school network (including Magnolia charters) is undisputed.

Another strong piece of evidence is that Magnolia branches of the Gülen charter school network bloomed under Rodriguez's CCSA board tenure. No less than five Magnolia schools were opened during the Rodriguez era:

  1. 2007 Magnolia Science Academy – 2 Valley (MSA-2)
  2. 2008 Magnolia Science Academy – 3 Carson (MSA-3)
  3. 2008 Magnolia Science Academy – 4 Venice (MSA-4)
  4. 2008 Magnolia Science Academy – 5 (MSA-5)
  5. 2009 Magnolia Science Academy – 6 Palms (MSA-6)

The proliferation of Gülen charter schools under Rodriguez's CCSA board term might explain why he has remained silent as to the serious charges of malfeasance against those schools. Rodriguez, who claims he wants to see "bad charters shut down," would do well to read Scott M. Folsom's sage words on the acts committed:

"Parental Choice does not give the right to parents to choose to send their kids to a bad school -- whether the school is bad because it does a crummy job of teaching students or managing the public's funds."

The fact that Rodriguez has been endorsed by long-time Gülenist supporters Monica Garcia and Caprice Young doesn't bode well for him offering any defenses. The latter is now a Gülen employee.

The unequivocal support of Los Angeles' Armenian community of Rodriguez's opponent, the Honorable Bennett Kayser, may be the most damning piece of evidence. Magnolia is tightly aligned with the Gülenist Pacifica Institute. In 2011 Armenian groups protested the organization's ties to Turkish groups denying the 1915-1918 Armenian genocide. That Ref Rodriguez and Monica Garcia are closely aligned to genocide deniers should concern voters to no end. Garen Yegparin, a journalist of Asbaraz Armeian news, wrote an excellent piece on the importance of voting, donating, and volunteering for your local candidates over the next few weeks.

Yegparin specifically writes about Bennett's race and what is at stake this Tuesday, May 19th: 


"But perhaps the most subtly important LA election is for the school board’s District 5 seat. Bennett Kayser, the incumbent running for reelection placed second, and faces a very strong challenger in the runoff. Kayser’s opponent is supported with serious money from the charter school movement (specifically, the California Charter Schools Association Advocates and its various tentacles), the same people from whom the Turkish Gulen movement has benefitted as it successfully encroaches on LAUSD schools."

"Consider that when all the spending in this race is added up (by the candidates themselves and independent expenditure committees for and against the candidates) Kayser’s opponent comes out 43% ahead in dollar terms! This is very unusual. It is more commonly the incumbent that has the money edge. It speaks to how much Kayser is being targeted." 

"We should be assisting him as much as possible. Unfortunately, his district covers areas which are not home to very many Armenians, which speaks to the principled nature of his stance. So that leaves volunteering (making phone calls or walking neighborhoods) and campaign donations, both of which can be done through the Kayser’s website, www.bennett2015.com."

 
Bennett Kayser is endorsed by the Armenian National Committee of America Western Region and the Armenian Council of America.  Kayser will also carry a resolution at the next LAUSD Board Meeting recognizing the 100th anniversary of the Armenian Genocide.

Los Angeles – New York money continues to attempt to buy influence in the Los Angeles Unified School Board race in District 5. Out-of-state “Reform, Inc.” money still pours in against local teacher and current Board member Bennett Kayser. One NYC billionaire was good for $450,000 as of December. Now, a front group from NYC linked to the hard-core Republican super PAC known as ALEC and the Koch brothers has inserted money in our school board race.

“Students for Education Reform” (SFER) has landed with boots on the ground, paid boots. (Whether they were flown in is another question.) SFER has spent $20,120.80 so far. Just two weeks in town and SFER has already violated our local ethics and transparency requirements.

SFER has failed to follow both California and the City of Los Angeles’ election ethics rules for mail communications. They are required to include a disclaimer specifying the name, address, a registered ID number and to inform the public who paid for the material and that additional information is available at ethics.lacity.org. Once again Rodriguez supporters are circumventing the law, violating local ethics rules and hiding out-of-state billionaire backers.

The following is SFER’s non-disclosure, “dis-closure” found on their mail: “Paid for by Students for Education Reform Action Network and not authorized by candidate(s) or any committee controlled by the candidate(s).”

SFER has received $1.6 million from Education Reform Now, whose PAC, Democrats for Education Reform (DFER), shelled out $1 million to attack the Chicago Teachers Union. DFER worked with the Koch brothers and ALEC to push Proposition 32, which if passed, would have blocked labor unions from using automatic payroll deductions for political purposes. Though SFER claims neutral territory, its motives are laid bare by its rallying around the funding of charter schools, the issue of limiting tenure, and its strict focus on testing. The testing corporations and charter school CEOs might agree with hedge funder and DFER founder Whitney Tilson’s explanation for his interest in education: “Hedge funds are always looking for ways to turn a small amount of capital into a large amount of capital.”

PROFITS! Why Ref Rodriguez and his CCSA covet the LAUSD Board Seat

Charter industry profiteer Refugio "Ref" Rodriguez, and his California Charter Schools Association's (CCSA) ruthless campaign to capture the Los Angeles Unified School District (LAUSD) Board of Education seat for District 5 has had every advantage. Rodriguez is backed with millions of dollars from an assortment of billionaires ranging from right-wing extremists like the Walton Family Fortune (Walmart) heirs to anti-public-commons ideologues including Reed Hastings, Eli Broad, and Michael Bloomberg. He has received uncritical press from all the major Los Angeles corporate media outlets. Rodriguez has waged a dishonest campaign that viciously mocked the incumbent school board member's disabilities, and went as far to make deplorable accusations of racism. With essentially unlimited funding at his disposal, one would think that the profit hungry corporate charter school executive wouldn't need any more advantages. However, Rodriguez and his CCSA allies are leaving nothing to chance in defense of their lucrative profits. Profits that have been threatened by an incumbent who has insisted that the charter industry serve all students, not just the ones that are "cheap" to educate.

Evidence of possible further impropriety was provided by Cheryl Ortega. Ortega is the Director of Bilingual Education at United Teachers Los Angeles, has taught in the community for nearly half a century, is a member of the Greater Echo Park Elysian Neighborhood Council, and was recently honored as the 28th Congressional District Woman of the Year. Given her long-standing ties to the community, parents frequently use her as a clearinghouse for education issues. For example, this revelation that she posted on her Facebook feed:

Interesting and shocking fact regarding the Kayser - Rodriguez LAUSD school board race. A long time friend and former school parent at Logan Elementary School, told me that parents at the Sandra Cisneros/Camino Nuevo Charter Corp School in Echo Park were paid to attend political meetings to help elect Ref Rodriguez. They were told that Bennet Kayser would "close down their school" if elected to the school board. I am not surprised at Camino Nuevo's message given their record of "misleading" parents.

Asking around, I've been informed that these parents are being paid in kind (not cash), with expensive dinners, trips to Starbucks, etc. These reports corroborate each other, and with definitive proof that CCSA and Rodriguez are chasing profits, their purported "payment" of parents to sway this election makes perfect sense. Who is doing it makes sense too.

Camino Nuevo Charter Corporation's profits depend on market share

Camino Nuevo Charter Academy Corporation (CNCA) has a long record of duplicity. Their fourteen member Board of Directors, comprised mostly of hedge fund/investment managers, venture capitalists, brokers, and bankers, is wholly unaccountable to the community. CNCA's campaign to expropriate the newly constructed CRES #14 school site during Gates Foundation employee Yolie Flores' so-called Public School Choice (PSC) charter school handout project, saw CNCA trying to stack the vote by busing in outsiders. CNCA lost to the community public school plan by more than 2 to 1 margin, but Flores gave them our school anyway. Charter schools using parents as political pawns for profits

It should be no surprise if CNCA is bribing parents to campaign and vote for Rodriguez. Even when they aren't using meals, gift cards, t-shirts, and other material enticements to induce parents into engaging in charter political activities, the lucrative charter school industry has another means of getting what they want—forced parent work policies. For years social justice activists have pointed out that CCSA, CCSA Advocates, Families that Can, and individual corporate charter chains have compelled parents to participate in their political activities by evoking their required "volunteer" hours. However, it wasn't until the watershed report from Public Advocates Inc. entitled Charging for Access: How California Charter Schools Exclude Vulnerable Students by Imposing Illegal Family Work Quotas was published that we began to recognize the full extent of this practice.

Wealthy Ana Ponce and Ref Rodriguez aiming for more profits

The essay PROFITS! Why Ref Rodriguez and his CCSA covet the LAUSD Board Seat exposed the connections between the CCSA, transnational corporations, and local charter school profiteers. This quote is extremely important:

CNCA Corporation's 2012 Form 990, Part VII§A shows Ponce stuffing her pockets with a mind-boggling $230,811.00. Her ties to Rodriguez extend beyond their mutual profiteering, and California Charter Schools Association (CCSA) board memberships. Ponce did postgraduate work at Loyola Marymount University (LMU), and Rodriguez is an adjunct instructor there. Sadly LMU's education department faculty and administration is dominated by neoliberal privatizers, like Shane P. Martin, who actively work to destroy public education at the behest of their corporate sponsors. The one exception to LMU's complicity with the Broad/Gates/Walton Triumvirate is that of renowned Freirian scholar Professor Antonia Darder, who writes brilliant essays like Racism and the Charter School Movement: Unveiling the Myths. Darder's is the sole voice of reason in LMU's cacophony of corporate concerns.

Paying parents to advocate for the charter industry's political and financial aims, whether those payments are in kind, through required "volunteer" hours, or any other form of consideration is highly unethical, immoral, and likely illegal. In other words, it's just the sort of thing that Refugio "Ref" Rodriguez and his CCSA cabal would do.

If you live in LAUSD District 5, I implore you to demonstrate to charter profiteer Ref Rodriguez, his CNCA allies, and his deep-pocketed CCSA trade association that our communities value pupils over profits. Reelect the Honorable Bennett Kayser in the May 19, 2015 General Municipal Election!

Most of the time the charter school industry's corporate leadership is able to craft their messaging so as to distract the populace from the real purposes undergirding their project. Occasionally, someone in their sector goes off script and tells the truth about what chartering is all about. Usually it's those in the sphere of finance capital—gleefully celebrating how lucrative the charter school industry has been for them. The Forbes piece, Charter School Gravy Train Runs Express To Fat City , is an excellent example of this. Sometimes individuals in the neoliberal corporate education reform camp spill the proverbial beans. Industry proselytizers like Andy Smarick and Paul Vallas have been candidly honest about charters discriminating against Students with Disabilities (SWD), and charters eschewing veteran teachers, respectively. Revelations of the dark secrets behind the charter industry's insatiable drive for profits also shine cleansing light on a current local issue—namely the attempts of charter industry profiteer Refugio "Ref" Rodriguez, and his California Charter Schools Association's (CCSA) campaign to capture the Los Angeles Unified School District (LAUSD) Board of Education seat for District 5. One of Rodriguez's fellow CCSA profiteers inadvertently provided incontrovertible evidence of why the school privatization camp spent over three quarters of a million dollars in the primary election alone.

A Twitter follow from a name I recognized as a marginal player in the corporate education reform camp sparked curiosity. A moment spent checking their LinkedIn profile yielded a veritable gold mine of information unequivocally proving the charter industry's, and particularly CCSA's, drive for profits comes at the expense of children and community. The prose from their profile says it all:

Profit margins, lead generation, and close ratios… refreshing honesty from an industry that claims it "puts kids first."

Like the hedge fund managers discussed in the Forbes piece above, platitudes about helping kids are quickly subsumed by talk of plentiful profits, revenues, and business opportunities when charter school executives talk among themselves. This focus on profits drives Ref Rodriguez's CCSA charter school industry trade association to eliminate any political opposition, and also explains their unhinged viciousness and ruthlessness towards the Honorable Bennett Kayser, our sitting LAUSD Board member, who has had the temerity to oppose charter schools placing greed over student need. Let's look more closely at CCSA's business dealings, how they harm students enrolled in charters, how they harm students enrolled in public schools, and then return to the implications of the May 19, 2015 General Municipal Election in Los Angeles.

Charters convert public funds into private profits

California Charter Schools Association's (CCSA) business ventures were so outrageously profitable, they drew in an array of corporations, privately held companies, and large foundations wanting a share. Firms like EdTec, Arthur J. Gallagher & Co., Charter Impact, Inc., and Discover Re (The Travelers Indemnity Company) jumped in CCSA's profits pool. Longtime school privatization advocates The Walton Family Foundation and Bill & Melinda Gates Foundation loomed large. Seeing an opportunity to exploit public education dollars nationally, the CCSA, Walton Family Foundation, Travelers, and Gallagher & Co. launched School Risk Management, LLC, which later became known as CharterSafe/PrivateSafe. Here is an excerpt of a 2007 press release from one of the corporate entities involved in this deal.

"In 2007 as a response to the growing need for appropriate insurance for charter schools nationally, Gallagher partnered with the California Charter School Association JPA and the Walton Family Foundation to form a risk management and insurance program for charter schools. This program has been known as the CharterSafe program. Recently the California Charter School Association JPA began promoting their self insured pool program as CharterSafe. In an effort it differentiate the national program from the California based JPA program, we have decided to change our program name. Going forward, we will be known as the Charter First Insurance Program."

Note the prominence of the right-wing-reactionary Walton Family Foundation in the press release. Walmart fortune heiress, Carrie Walton Penner, is currently the CCSA Board Vice-Chair (term ending 6/30/2017). By most accounts Walton Penner is close to both profiteer "Ref" Rodriguez of the PUC Charter School Corporation, and the well-heeled Ana Ponce of the Camino Nuevo Charter School Corporation. Rodriguez was a CCSA Board member from 2005 to 2009, while Ponce currently serves as the CCSA Board secretary. Like all 501c3 "non-profits", the CCSA Board is unelected, and, to all intents and purposes, is unaccountable to anyone other than its charter executive membership and private funders. CCSA's public funders (the taxpayers) have no voice in the 501c3 corporation's affairs. Its private investors get seats on the board. Known for their aversion to public education, and their exploitation of working class families, the Walton Family Foundation is CCSA's biggest funder. In 2010 they showered the CCSA charter school industry association with a staggering $3,940,652.00. Annual investments like that are nothing when one considers the return of investment in the forms of profitable finance capital spinoffs like CharterSafe, LLC.

The avaricious insurance executive… ahem, "education entrepreneur" who oversaw growth of the hugely profitable CCSA CharterSafe enterprise, then launched his own consulting firm to skim more money from the trough of public funds. Funds which became entirely unregulated when the charter school industry was created by corporate interests in the nineteen-nineties. Refugio "Ref" Rodriguez's revenue hungry PUC charter school chain is a client of that selfsame consulting firm.

The money making aspect of chartering is so predominant, that peripheral concerns like pupils, pedagogy, or populace are not part of the discussion. Here is a LinkedIn endorsement for our CharterSafe protagonist by the Senior Vice President for Strategic Initiatives at the National Alliance for Public [sic] Charter Schools:

"Ted is one of the most creative people I know. He is an excellent partner because he always makes sure the business relationship benefits both parties. I have introduced him to our customers, and they always come away impressed."

I doubt many think of children, schoolteachers, or education when they see phrases like "business relationship", or "introduced him to our customers", but that's what the charter school project is all about—business. Big business at that.

The charter industry's profits-first agenda hurts it's own students

The CCSA counts 14 of the schools comprising Refugio "Ref" Rodriguez's charter empire among its membership. As mentioned above, CCSA and its business partners profit from selling financial products and services to its corporate charter members. Additionally, just like the U.S. Chamber of Commerce, CCSA charges dues. Their formula is based on enrollment. Of issue is whether these corporate charters can demonstrate that the dues they pay to their trade association come from somewhere other than taxpayer funds intended for students. Rodriguez's PUC has paid well over a hundred thousand dollars into the CCSA slush fund, which in turn is used for political lobbying to increase charter industry profits. Those funds, regardless if they came straight out of taxpayer pockets, or are front end investments from billionaire ideologues like Walton Penner, would be better spent on students. Yet as we saw above, when it comes between profits and pupils, the charter industry always prioritizes the former. The "non-profit" designation of the charter industry is simply a tax status, indicating they don't have shareholders. The 501c3 "non-profit shells" of these organization merely serve as a fronts to the myriad businesses they feed education funds to. Real estate, leasing, insurance, administration, and many more lucrative industries benefit from this arrangement.

Charter executives make sure they partake of the profits too. I remember interviewing a young person who had worked for a wholly owned subsidiary of the Green Dot Charter Corporation. They told me they had lost any illusions that they were a "non-profit" when they saw Green Dot's Alma Vivian Marquez roll up in a brand new Porsche Cayenne. A sampling of Los Angeles corporate charter school CEO salaries is eye opening, especially when one realizes that they all work for schools with a tiny fraction of the student population that the public school district serves:

While representatives of the lucrative charter industry claim they run public schools, entities tasked with using precise legal definitions all say otherwise. This includes the 9th Circuit U.S. Court of Appeals, the California Court of Appeals, and the National Labor Relations Board, all of which are on record stating that charter schools are not public entities. The most authoritative framing of this issue comes from the U.S. Census Department:

"A few "public charter schools" are run by public universities and municipalities. However, most charter schools are run by private nonprofit organizations and are therefore classified as private."

Like the rest of the private sector, the charter industry must continually increase market share in order to maintain profitability. One of the ways they do this is through advertising. Rodriguez's corporate charter schools squander untold amounts of taxpayer funds on advertising in pursuit of growing market share, and hence increased profits for the business interests associated with his schools and his CCSA trade association. Our tax dollars are being leveraged in order to secure more of our tax dollars to fuel the revenue hungry machine that is the charter school industry. Obviously this is of no concern to profit minded charter executives like Rodriguez, but those funds could, and should, be spent in the classroom for student learning, instead of growing market share for the burgeoning charter school sector. Ironically these corporate charter school chains frequently claim they have long "waiting lists," so why the need to advertise? In a word the whole waiting list myth is another part of their marketing scheme.

Despite having additional resources invested in them by billionaire foundations, not to mention their being able to control their student populations through selective enrollment, attrition, and outright discrimination against Students with Disabilities (SWD), PUC charter schools, while profitable, haven't done much for students. For example, in 2013 students from Rodriguez’s Early College Academy for Leaders and Scholars (ECALS) took the California State University (CSU) entrance exams. Half of those taking the test failed to test proficient in either mathematics or English. The fifty percent of Rodriguez's students that failed had to take remedial high school classes.

Other corporate charter school chains, like Alliance, Camino Nuevo, and Green Dot, have had years where up to ninety-eight percent of their "graduates" failed to test proficient in either mathematics or English. If the tradeoff for public control and oversight of our education dollars was supposedly to accommodate these so-called "high performing," privately managed entities, then we have been duped. The only area where charter schools have performed well is that of funneling precious education funding into the coffers of the corporate interests they serve.

The charter industry's profits-first agenda hurts public school students

I recently wrote in response to a charter chain getting away with defrauding the public for millions of dollars.

"One cringes thinking of all the Los Angeles Unified School District (LAUSD) public school libraries that could have been reopened with those millions "missing" from the privately managed Magnolia Gülen Charters."

This sentiment holds true across the board. For every education dollar that winds up in the hands of hedge fund managers, business bankers, and corporate executives, there is a public school child suffering from the inequity of a system being systematically starved of resources. In March of 2015 The Center for Popular Democracy released a groundbreaking report entitled Risking Public Money: California Charter School Fraud. The report meticulously details tens of millions of dollars in fraud stemming from this essentially unregulated industry, and suggests that "[b]ased on conservative estimates, California stands to lose more than $100 million to charter school fraud in 2015." As a community organizer I constantly hear parents talk about overcrowded classrooms and lack of resources. It is incomprehensible that at the same time our neighborhood public schools are in desperate need, our community's funds are wantonly, recklessly, and even fraudulently squandered by the opaque structures of the privately managed charter school industry.

In response to our public schools being short changed because of the myriad shortcomings of the lucrative charter school industry, the Honorable Jackie Goldberg founded the Transparency, Equity, and Accountability in Charter Schools (TEAch) organization a few years ago. Everyone should support TEACh, even families with children enrolled in privately managed charter schools. Their mission statement: "An organization working to ensure that charter schools are Transparent, Equitable, and held Accountable for their practices."

Aside from budget woes created by the charter sector syphoning our education dollars off into corporate coffers, another area where public school students are most hurt by charter industry's profits-first agenda is that of special education. The 2008 Andy Smarick piece alluded to earlier outlines how the charter industry deliberately avoids enrolling Students with Disabilities (SWD) to save money and uses that additional financial burden to bankrupt the public school district. His words echo the neoliberal ideology of eliminating the public commons in favor of a profitable, private sector:

"As chartering increases its market share in a city, the district will come under growing financial pressure. The district, despite educating fewer and fewer students, will still require a large administrative staff to process payroll and benefits, administer federal programs, and oversee special education. With a lopsided adult-to-student ratio, the district's per-pupil costs will skyrocket." [emphasis mine]

As a society we must stand against the exploitation of our most vulnerable. Frankly, any school getting public funding should be obligated legally, ethically, and morally to educate every child. If it is too difficult for the charter school industry to stop prioritizing corporate greed over special education need, then there needs to be discussions of shutting down their industry. Los Angeles School Board members who have attempted to enforce these obligations on charters have been savaged by the CCSA. Bennett Kayser's principled stand against the lucrative Aspire Charter Corporation is notable. Depending on which source one cites, Aspire either served a negligible number of SWD, or none at all at the time of Kayser's opposition to their charter renewal:

"But a look at area special education programs provides insight into the types of students served by Aspire. ¶ El Dorado's special ed program does not serve a single visual or hearing impaired student nor students with multiple disabilities, orthopedic or brain injuries, according to state reports. L.A. Unified's program serves many of these disabilities, requiring highly-specialized, costly care." (KPCC, April 16, 2014)

This is unacceptable. We already saw James R. Willcox's compensation package above. Children in both the public school system, and the privately managed charter school sector, deserve better than to have the funds we alloted them diverted into private hands.

The billionaire backed CCSA campaign for the May 19, 2015 School Board election

With prodigious profits for themselves and their investors at stake, the California Charter Schools Association (CCSA) launched a scorched earth campaign to get one of their longtime industry operatives, Refugio "Ref" Rodriguez, elected. Dr. Andrew Thomas, the third place finisher in the primary election for the LAUSD District 5 seat, wrote the following commentary regarding the ideologically charged billionaires supporting CCSA's SuperPAC for Rodriguez:

Why are out-of-district billionaires such as Netflix Chief Executive Reed Hastings, former New York Mayor Michael R. Bloomberg, Jim Walton of the Wal-Mart founding family, and local philanthropist [sic] Eli Broad spending over a $1 million in this school board race?

In defense of their profits, Rodriguez and his CCSA trade group launched the most deplorable and dishonest political campaign in recent memory. One lie and innuendo packed CCSA mailer attacking the Honorable Bennett Kayser was so repugnant that it saw Kayser's fellow board member, the Honorable Dr. George McKenna, calling the CCSA out for being "racially inflammatory". Rodriguez's CCSA trying to paint their opposition as racist is no small irony, given that the CCSA was founded by bigoted nativist Steve Poizner. Another series of Rodriguez's CCSA attacks mocked Kayser's disability. Kayser, who suffers from Parkinson's Disease, has been one of the strongest advocates for Student with Disabilities (SWD) the district has had in years. As discussed above, the charter school industry sees SWD as an impediment to their profits, so Kayser's standing up for those students has made him CCSA's biggest target.

With almost unlimited funding at their disposal, Rodriguez and his fellow CCSA profiteers look to seize the LAUSD District 5 Board of Education seat and use it as a means to increase charter market share, proliferate profits, and eliminate any oversight interfering with those first two goals. An important question we should be asking ourselves is why can charter industry executives run for our public school board, but no member of the public can ever run for the boards of their charter school empires?
